iConfirm Terms of Service — v2

These Terms of Service ("Terms") are a legal agreement between BIBS Specialty Services, Inc. ("BIBS," "iConfirm," "we," "us," or "our") and the adult accepting these Terms ("you"). They govern access to the iConfirm web application and related services (the "Service").

If you purchase or administer the Service for a Church, the Church Service Agreement and Data Protection Addendum also apply. If those documents conflict with these Terms concerning the Church's organization account, the Church Service Agreement controls.

1. Acceptance and authority

You must be at least 18 and legally capable of entering an agreement to accept these Terms. By creating a Parent account, you represent that you are the Student's parent or legal guardian, or otherwise have legal authority to authorize the Student's use and exercise applicable rights for the Student.

A Student may use the Service only through an account created and authorized by a Parent. The Service is designed for United States Students age 11 and older. A Student's use is subject to these Terms and the Student Privacy and Acceptable Use Notice, but we do not rely solely on a minor's assent to bind the Parent.

The Service is offered for use in the United States and is not currently designed to address legal requirements outside the United States.

2. Accounts and security

You must provide accurate information, keep account access secure, and notify us promptly of suspected unauthorized access. Parent access uses a verified email process. Student access uses a PIN, which is stored in hashed form.

Only the Parent may reset a Student's PIN. Church Leaders cannot obtain or reset Student PINs. You may not share credentials, impersonate another user, bypass permissions, or attempt to access another Church tenant or private Student content.

3. Student privacy and Church visibility

Leaders may view a Student's name/nickname, attendance, lesson progress and completion, and content the Student deliberately marks shared. Leaders do not receive private reflections or private survey responses through the Service.

The Service protects this boundary through application permissions and query controls. Private entries are not end-to-end encrypted, and BIBS's sole authorized operator can technically access plaintext records for a verified Parent request, security, support, legal compliance, or another documented operational need. Private entries are not routinely read or monitored.

iConfirm is not counseling, medical care, emergency response, pastoral monitoring, or a legally privileged confessional service. Do not use a private entry to request emergency assistance. Call 911 or contact an appropriate trusted adult in an emergency.

4. Parental notice, consent, and rights

Before activating a Student account, we provide the Parent a direct notice and seek affirmative, verifiable consent to the collection, use, and disclosure of Student information. You agree to provide truthful consent and authority information.

A verified Parent may contact office@iconfirm.app to review, export, correct, delete, or stop further collection of the Student's information. Withdrawal or deletion may make continued use impossible.

5. Subscriptions, renewal, cancellation, and refunds

Parent/Student seats and Church/Leader seats are separate subscriptions. Current options may include monthly and annual recurring subscriptions. The price, billing period, renewal date, and any discount displayed at checkout control your purchase.

Subscriptions automatically renew for the displayed billing period until canceled. Before charging you, we will clearly disclose the material renewal terms and obtain your express agreement.

You may cancel at any time using the Cancel subscription button in your account settings, which opens our payment processor's secure cancellation portal and processes immediately. You may also cancel by emailing office@iconfirm.app from your account email, as a backup channel that may take longer to process. Cancellation takes effect at the end of the then-current paid period. Except where law requires otherwise, payments are nonrefundable and we do not prorate unused time.

[BUILD REQUIRED — not yet built] The in-app cancel button does not exist yet for Student/Parent seats. Do not describe this as available until it is built and tested.

6. Student content and ownership

As between you, the Student, and iConfirm, the Student—or the Parent while legally exercising the minor Student's rights—retains ownership of original reflections, notebook entries, survey responses, and other original content submitted through the Student account ("Student Content").

You grant iConfirm a limited, nonexclusive license to host, store, reproduce for backup and recovery, transmit, and display Student Content only as necessary to operate the Service, honor the Student's sharing selection, fulfill verified Parent rights, secure/support the Service, and comply with law. This license ends when the content is deleted, except for temporary technical copies and records lawfully retained under our retention policy.

You represent that Student Content may lawfully be submitted and does not infringe another person's rights.

7. Sharing choices

A Student may choose to mark specific content as shared with authorized Church Leaders. Shared content may be viewed or exported by the Church. A Student may revoke a sharing choice at any time using the in-app sharing control, which stops future access through the Service; the Church will be asked to delete existing exported copies where feasible, but iConfirm cannot retrieve copies independently printed, photographed, or retained outside the Service.

8. Photos

Photo uploads are not available at launch. Users may not attempt to bypass this restriction or upload files through an unauthorized route. Before enabling photo uploads, iConfirm will publish applicable rules and implement reporting, immediate hiding pending review, verified Parent deletion, and authorized takedown controls, including the prohibited-content and apparent-CSAM provisions those controls require. This section will be expanded with that full language at the same time photo uploads ship — it is intentionally not needed while the feature stays off.

9. Acceptable use

You and the Student may not:

10. Church responsibilities

Churches control whom they designate as Leaders and are responsible for Leader conduct, timely revocation notices, lawful program administration, and their copies of progress and shared content. A Church may not demand Student credentials or private entries. Church Leaders must direct PIN-reset requests to the Parent.

11. iConfirm intellectual property

Except for Student Content and third-party material, BIBS owns the Service, software, curriculum, visual design, and related intellectual property. Subject to these Terms and payment, we grant authorized users a limited, revocable, nontransferable right to use the Service for its intended confirmation-program purposes.

Bible translations and other identified third-party works remain owned by their publishers/licensors and are used subject to their terms. CEB text will not be included unless BIBS has retained written permission appropriate to the Service; otherwise an approved fallback translation will be used.

12. Third-party services

The Service depends on Supabase, Vercel, Resend, Stripe, internet access, and other systems outside our direct control. Their availability and terms may affect the Service. Our use of personal information remains governed by the Privacy Policy and applicable law.

13. Changes and availability

We may modify, suspend, or discontinue features. We do not promise a particular uptime percentage or service level. We will provide at least 30 days' advance notice of material changes to these Terms, pricing, or the Service when reasonably practicable. Changes requiring renewed parental consent will not apply to a Student until required notice and consent are completed.

14. Termination and data retrieval

You may stop using the Service or cancel the subscription. We may suspend or terminate access for material breach, nonpayment, security risk, unlawful conduct, or discontinuation.

After paid access ends, ordinary Student use is intended to lock by day 5 while export remains available. Student Content remains available for retrieval through day 90 and is then deleted under the Privacy Policy and retention schedule. Minimal transaction, consent, security, dispute, and legal records may remain for their specific lawful purposes.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." BIBS DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

The Service supports religious education but does not replace the Church's supervision, safeguarding, pastoral judgment, emergency procedures, or legal duties.

Some jurisdictions do not allow certain disclaimers, so they apply only to the extent permitted by law.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIBS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR GOODWILL.

EXCEPT FOR LIABILITY THAT CANNOT LAWFULLY BE LIMITED, AND EXCEPT FOR CLAIMS ARISING FROM A PRIVACY OR SECURITY BREACH OR A CHILD-SAFETY INCIDENT, BIBS'S TOTAL LIABILITY ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE FEES PAID TO BIBS FOR THE APPLICABLE ACCOUNT DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

This carve-out stands on its own and does not depend on BIBS holding cyber/E&O insurance. Once a policy is bound, BIBS will confirm the policy's coverage is consistent with this clause, but the clause itself is not contingent on that purchase.

17. Disputes

Missouri law governs these Terms without regard to conflict-of-law rules. Disputes not resolved informally will be brought in the state courts located in the City of St. Louis, Missouri, or the applicable federal court, except where consumer protection law requires another forum or where you may bring a claim in small-claims court.

Removed from v1: consumer arbitration. Per the Aug 21 legal review memo (finding F-12), a consumer arbitration clause was deleted rather than perfected — see the change note at the top of this document.

18. General terms

These Terms and incorporated documents are the entire agreement for the covered Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; BIBS may assign them in connection with a merger, sale, or reorganization subject to applicable privacy obligations. Electronic notices and acceptance have the same effect as paper where permitted by law.
